I was told by an expert in state constitutional ERAs that ERA could
have an impact over time in the courts. At the very least, it would
set a new precedent that discrimination based on . is
unconstitutional in the same way race is. The Hawaii case used the
argument that if a man can marry a woman legally then it is
discrimination based on . if a woman cannot marry a woman.
