If he had escaped to Switzerland... He would have
been extradited - possibly by Italy, for treason
against the recognized Italian government. Or for
war crimes in Yugoslavia, France, or the USSR.
Once he was in custody, he could be tried for
crimes against peace, if anybody wanted to.
